The petitioner seeks bail in Bithan P.S. Case No. 53 of 2016 under Section 47(A) and 54 of the Excise Act (Amendment), 2016.

485 bottles, containing 180 ML MacDowell, Imperial Blue 375 ML, 750 ML, 180 ML, and royal stag 750 ML and 180 ML were recovered from the house of the petitioner. It appears that about 111 litres of Indian made foreign liquor was recovered from the house of the petitioner, for that the petitioner is in jail custody since 6.1.2017. The petitioner has already remained in jail for three and half months.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.14820 of 2017 (2) dt.18-04-2017 2/2 petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Rosera, Samastipur in connection with Bithan P.S. Case No. 53 of 2016.
