JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-12-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of appropriate writ in the nature of mandamus seeking a direction upon the Respondents specially the Respondent No. 4 to not construct double story general Refreshing Hall in Ward No. 18 of Nagar Panchayat, Jhajha, which is being made over the public passage, leading to obstruction of the ingress and outgress of the petitioner from his house, in connivance with the Respondent No. 4 and that too without obtaining no objection from the Circle Officer, Jamui.

(ii). For issuance of appropriate writ in the nature of mandamus seeking a direction upon the

Patna High Court CWJC No.4859 of 2020(4) dt.11-12-2024 2/2 Respondents to stop making construction of public refreshing hall, which is being made over the public passage, without prior permission and determination of spot for such construction." 2.

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Jamui, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches the District Magistrate, Jamui, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

Accordingly, the writ petition stands disposed off on the aforesaid terms.
