JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 12-02-2015 Assailing the decision dated 29.1.2014 taken by the Debts Recovery Tribunal, Patna in M.A. No. 470 of 2013 and M.A. N. 7 of 2014 (Smt. Neeta Jha &ors Vs. A.O. Syndicate Bank), the Bank preferred appeal bearing Appeal No. 16 of 2014 before Debts Recovery Appellate Tribunal , Allahabad.

A joint submission at the Bar is that the appeal is pending for the last one year but no hearing could take place in view of the fact that the office of the Chairman of the Appellate Tribunal is still vacant. But now a supplementary affidavit has been filed stating that Debts Recovery Appellate Tribunal, Delhi is functioning as incharge of Debts Recovery Appellate Tribunal, Allahabad. Such being the situation, this writ application is

Patna High Court CWJC No.1968 of 2015 dt.12-02-2015 2/2 being disposed of directing the Debts Recovery Appellate Tribunal, Delhi, which is admittedly now incharge of the Debts Recovery Appellate Tribunal, Allahabad, to take up the appeal and after its hearing take a decision on its own merit and in accordance law. Since much delay has already occurred, it is expected that the Appellate Tribunal would dispose of the aforesaid appeal expeditiously preferably within a period of four months from the date of receipt / production of a copy of this order. The petitioner as well as respondent are also expected to cooperate for expeditious disposal of the appeal concerned. (Dr. Ravi Ranjan, J) Spd/- U
