JUSTICE SANJAY PRIYA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Triveniganj P.S. Case 149 of 2016 instituted for the offence under Sections 363 and 364 of the Indian Penal Code.
It has been submitted that the accused Vijay Tanti named in the First Information Report has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 9.2.2017 passed in Cr. Misc.52251 of 2016. From the written report it appears that the petitioner is not named.
From the order of learned Sessions Judge it appears that name of petitioner has been surfaced because the petitioner's SIM was used in the mobile set of the victim. The petitioner is
Patna High Court Cr.Misc. No.8847 of 2017 (3) dt.06-04-2017 2/2 said to be in custody since 25.11.2016. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Supaul, in connection with Triveniganj P.S.
