The petitioner apprehends his arrest in Motipur P.S. Case No.56 of 2013 registered under Sections 366(A) and 120(B) of the Indian Penal Code.

The father of the victim alleged that his minor daughter was traceless. On enquiry, it transpired that Dharmendra Sahni, Prabhu Sahni, Parmeshwar Sahni, Prem Sahni, Hriday Sahni and wife of Hriday Sahni conspired with each other and kidnapped his daughter.

Learned counsel for the petitioner submits that the petitioner is the brother of Dharmendra Sahni. In fact, the victim left her house and she was living with Dharmendra Sahni. Dharmendra Sahni has already been granted bail in

Patna High Court CR. MISC. No.12118 of 2019(2) dt.27-02-2019 2/2 Cr. Misc.No.14814 of 2014. Similarly situated co-accused Prabhu Sahni and Prem Lal Sahni @ Prem Sahni have also been granted anticipatory bail in Cr. Misc.No.37535 of 2018. The case of the petitioner stands on same footing. Having considered the facts that similarly situated coaccused, namely, Prabhu Sahni and Prem Lal Sahni have already been granted anticipatory bail, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West, Muzaffarpur in connection with Motipur P.S. Case No.56 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
