The petitioner seeks bail in Chhatauni P.S. Case No. 23/2016, registered for the offences punishable under Sections 414, 399, 402, 120B and 34 of the Indian Penal Code. The police got information that many persons assembled at a lonely place for committing crime. The police raided the place and arrested three persons namely, Shailesh Kumar Yadav, Upendra Kumar Rai and Raju Kumar. The apprehended accused are said to have disclosed that at the instance of the petitioner they had assembled there for committing crime.

It is submitted that the petitioner was in custody at the time of occurrence. All other accused persons who were

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 13, Motihari East Champaran in connection with Chhatauni P.S. Case No. 23/2016.
