JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is apprehending arrest in a case registered for the offences punishable under sections 304B,302 and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after five years of marriage for non fulfillment of dowry demands.

It is submitted by learned counsel for the petitioner that actually marriage was performed in 2004, hence, the case does not come within the purview of section 304B IPC. It is further submitted that the victim died due to acute diarrohea and the informant retracted from the initial version.

Patna High Court Cr.Misc. No.4083 of 2015 (2) dt.30-01-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Halsi P.S. Case No. 36 of 2013 pending in the court of learned J.M. Ist Class, Lakhisarai.

This application is disposed of with the aforesaid observation/direction.
