2. The petitioner is in custody in a case registered for the offence punishable under Sections 467, 468, 471 and 420/34 of the Indian Penal Code.
3. As per allegation in the FIR, a search was made in the house of the petitioner and found altogether 16 records/documents relating to Halsi Revenue Circle was recovered and on interrogation petitioner disclosed that he is the resident in the said room for last ten years where he assist the Halka Karamchari.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to
Patna High Court CR. MISC. No. 13305 of 2024(3) dt.18-04-2024 2/2 suspicion only and no specific allegation against the petitioner . He next submits that no incriminating article has been recovered from the conscious possession of the petitioner rather the alleged recovered documents are genuine and valid documents and custodian of the aforesaid documents is the Halka Karamchari of the Block Halsi and, as such, no case is made out against the petitioner as stated in para-10 of the petition. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 15.12.2023.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Lakhisarai in connection with Halsi P.S. Case No. 335 of 2023.
