JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 8261 of 2018, arising out of Sultanganj P.S. Case No. 254 of 2018 for the offence under Sections 401, 379, 411, 414 of the Indian Penal Code, Sections 25(1-b)a, 26/35 of the Arms Act and Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 07.09.2018. He further submits that in the instant case one Samsung Mobile was recovered.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court CR. MISC. No.11523 of 2019(2) dt.26-02-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 8261 of 2018, arising out of Sultanganj P.S. Case No. 254 of 2018.
