JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioners and Mr. Yogendra Kumar, learned A.P.P. for the State. The petitioners seek bail in connection with Sakara P.S. Case No. 501 of 2021 instituted for the offences under Sections 147, 148, 149, 188, 341, 332, 333, 307, 504 and 506 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 12.10.2021, are persons of clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 2.220 liters of liquor from the house of Bali Ram where a party was going and the police on

No.10931 of 2022(2) dt.11-03-2022 2/2 information reached the place of occurrence where a quarrel between the persons who are attending the party and the police institute in which it is alleged that police personal are injured. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the case and they were not present at the place of occurrence rather they were merely a passer by came to be implicated when the police had reached the house of Bali Ram.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioners are in custody since 12.10.2021, charge-sheet has been submitted in the case and are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Muzuffarpur in connection with Sakra P.S. Case No. 501 of 2021.
