JUSTICE SATYAVRAT VERMA ORAL ORDER 16-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Bikram P. S. Case No.60 of 2020 registered for the offences punishable under Section 392 of the I.P.C.

From bare perusal of the F.I.R., it would manifest that the informant alleges that while he was returning on his tractor, in the mid-way, four unknown persons riding on a four wheeler intercepted him and forcibly took his vehicle in their possession and dragged him inside their car and proceeded and after sometime he was thrown out from the car after snatching Rs.6,000/- from him.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name has transpired

Patna High Court CR. MISC. No.21359 of 2021(2) dt.16-11-2021 2/2 in the confessional statement which he made before the police as he was remanded in Shahpur P. S. Case No.106 of 2020. It is further submitted that since the confession before police is not admissible in the eye of law as such, much reliance cannot be placed on the confessional statement of the petitioner before the police and the F.I.R. was against unknown and petitioner has been apprehended why he was not put on T. I. Parade. It is further submitted that petitioner is in custody since 16.06.2020 and charge-sheet has been submitted in this case. Considering the fact that petitioner was not put on T. I. Parade and is in custody since 16.06.2020 and charge-sheet has been submitted in this case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Danapur, Patna in connection with Bikram P. S. Case No.60 of 2020.
