It is stated by learned counsel for the petitioner that a counter affidavit was served upon him on 19.1.2016, but copy of the same is not available with the State Counsel as the file has come to him on transfer. It does not appear from the computer report that the same has been filed.

In the aforesaid view of the matter, the writ application appears to have become infructuous. It is accordingly, dismissed as infructuous.
