The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
The FIR was lodged against unknown when the motorcycle of the informant being stolen. The name of the petitioner sprang up during investigation on confession. It is submitted by learned counsel for the petitioner that except confession of the co-accused there is nothing on record to suggest the complicity of the petitioner. The impugned order also does not suggest anything except the
Patna High Court Cr.Misc. No.4609 of 2016 (2) dt.03-02-2016 2/2 confession of the co-accused. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bettiah Town P.S. Case No. 385 of 2012 pending in the court of learned Judicial Magistrate, Ist Class, Bettiah, West Champaran. With the aforesaid observation, this application is disposed of.
