JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and Mr. Zainul Abedin, learned A.P.P. for the State. The petitioner seeks bail in connection with Sakra P.S. Case No. 466 of 2019 instituted for the offences under Sections 420, 467, 468, 272 and 273 of the Indian Penal Code and Section 30(a), 30(c), 30(d) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is in custody since 23.12.2021, has antecedent of three cases, charge-sheet has been submitted in the case and allegation is of recovery of 159.8 liters of liquor from a wash room.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 23.12.2021, charge-sheet has been submitted in the case and petitioner was not arrested from the spot nor recovery was made from his premises, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Court No.1, Muzuffarpur in connection with Sakra P.S. Case No. 466 of 2019.
