NILU AGRAWAL ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 27.12.2016 in connection with Begusarai Town P. S. Case No. 612 of 2016 registered for the offence punishable under Section 30 (a) of the Bihar Excise (Amendment) Act, 2016.

The prosecution case as lodged by the police personnel is that on a secret tip off, they raided the house of one Rahul Singh and found 55 bottles of Royal Stag 180 ml each near cot in jute bags and the petitioner along with other co-accused were found sitting there. Accordingly, seizure list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in the aforesaid case. However, learned A.P.P. for the State submits that the petitioner is named in the F.I.R. and does not have clean antecedent, hence, opposes the prayer for bail. Considering the facts and circumstances and the submission of the parties, let the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/-( Rupees ten thousand) with two sureties of the like amount each in connection with Begusarain (Town) P. S. Case No. 612 of 2016 to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, subject to the condition that the petitioner is directed to appear before the police/Court as and when required.
