Permission accorded.
Heard the parties.
Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 354, 427, 379, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Patna High Court CR. MISC. No.11523 of 2023(2) dt.15-05-2023 2/2 Allegation against these petitioners is that they assaulted the informant and his family members by means of various weapons.
Learned counsel appearing for the petitioners submits that due to petty dispute a simple altercation took place between the parties in which both sides sustained injuries. Injuries caused by the petitioners are simple in nature. Case and counter case. Petitioners have got clean antecedent.
Learned counsel for the informant vehemently opposes the bail application.
Considering the nature of accusation and simple nature of injury, let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gaya in connection with Konch P. S. Case No. 384 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
