JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 505 of 2014 registered under Sections-365/34 of the Indian Penal Code.
Although the petitioner is named in the first information report with allegation that he as well as others kidnapped the Government doctor but from perusal of the statement of the victim recorded under Section-164 of the Cr. P.C. it would appear that the alleged kidnapping was neither for ransom nor for murder.
Therefore, considering the above-said facts and
Patna High Court Cr.Misc. No.5154 of 2015 (2) dt.06-02-2015 2/2 circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named-above, in the event of arrest or surrender in the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Madhepura P.S. Case No. 505 of 2014 to the satisfaction of Chief Judicial Magistrate, Madhepura subject to conditions as laid down u/S 438(2) of the Cr. P.C.
