2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Gwapara (Arar O.P.) P.S. Case No. 86 of 2024 registered under Sections 427, 436, 385, 387, 504, 506 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per FIR, the allegation against the petitioner is to raise demand for ransom of Rs.1 lakh from the informant and upon refusal, put his house upon fire along with four unknown accused persons.

4. It is submitted by learned counsel that the specific allegation as to cause mischief by fire qua dwelling

Patna High Court CR. MISC. No.11855 of 2025(2) dt.02-04-2025 2/3 unit of the informant is available against co-accused Nityanand Yadav. It is submitted that the allegation against this petitioner is very much general and omnibus. It is pointed out that the narration of FIR itself suggest that parties were in inimical terms before lodging this FIR and the criminal cases were also pending between them. The petitioner is said to a man of clean antecedent.

5. Learned APP opposed the prayer of bail.

In view of aforesaid factual submissions and by taking note of the fact as the allegation qua petitioner is appearing very much general and omnibus rather causing mischief by fire to the dwelling unit of informant is available specifically against co-accused Nityanand Yadav, where the petitioner is a man of clean antecedent, accordingly, the petitioner, above-named in the event of his arrest or surrender in the court below within a period of four weeks of this order is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Udakishunganj,
