It is contended on behalf of the petitioner that he has submitted tenders in response to Invitation Notice contained in Annexure-2 for work Integrated Action Plan (I.A.P.). The technical bid and financial bid have been conducted and petitioner has succeeded. However, even though about one year has elapsed but no final decision has been taken by the respondent no.2 the Secretary, Minor Water Resource Department, Bihar, Patna.

It would be very difficult for this Court to issue a mandamus directing the State authority to enter into a contract in
