JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

It has been submitted that SHO of Govindpur searched the bus of 'Maa Janki' and recovered 18.925 liters of foreign liquor and 20 liters of country made liquor. The conductor of the said bus was apprehended and this petitioner who is said to be the driver of the bus along with one Munna Singh fled away. It is mentioned in the written report that the apprehended conductor disclosed the name of the petitioner and one Munna Singh. Munna Singh has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 19.11.2016 passed in Cr. Misc. 43335 of 2016.

Case No. 70 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the conditions as laid down under Section 438 (2) Cr.
