The petitioner is apprehending his arrest in connection with G.R.No.1303 of 2017 (arising out of Kotwali P.S.Case no.184 of 2017 dated 1.6.2017 registered for offences punishable under Sections 420/406 of the Indian Penal Code. Allegation against the petitioner, who was employee of the Axis Bank that after collecting amount from the depositors he fled away and as such he misappropriated amount of Rs.3,80,350/-.
Submission of the learned counsel for the petitioner is that there are no materials available on the record to show that he has collected amount from the consumers and the whole allegation is false and concocted.
Heard learned A.P.P. , who has opposed the prayer for
Patna High Court CR. MISC. No.11323 of 2019(4) dt.08-05-2019 2/2 bail on the ground that the witnesses have also supported the allegation against the petitioner and it further shows that the bank has approached the family members of the petitioner to deposit the amount but in spite of that he has not appeared before the Bank.
Having heard both sides and considering the aforesaid facts, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail.
With the aforesaid direction, this application is dismissed.
