JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 25.12.2019, seeks bail in connection with Hisua P.S. Case No. 473/2019 , dated 21.11.2019, instituted for the offence under Section 30(a) of the Excise Act. It appears that 125 litres of locally brewed liquor was recovered from the kiln of the petitioner which is situated by the side of a drain.

Learned counsel for the petitioner submits that the recovery is not from his kiln, rather from the drain and it has falsely been shown to have been recovered from the kiln belonging to the petitioner. The petitioner was earlier also made accused in a case of similar nature

Patna High Court CR. MISC. No.13352 of 2020(2) dt.03-03-2020 2/2 but considering the accusation in that case, he has been granted bail.

Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge IIcum-Special Judge, Nawada In connection with Hisua P.S. Case No. 473/2019.

The application stands allowed.
