Petitioners apprehend their arrest in connection with Belaganj P. S. case no. 150/2014 registered under sections 272, 273/34 of the IPC and section 47 of the Excise Act. Admittedly, neither petitioners were caught on the spot nor anything was recovered from their conscious possession and their names were disclosed by local chaukidar. Furthermore, petitioners do not have any criminal antecedent which is evident from para 3 to this petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to
Patna High Court Cr.Misc. No.4297 of 2015 (2) dt.02-02-2015 the satisfaction of the Chief Judicial Magistrate, Gaya in Belaganj P. S. case no. 150/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
