The petitioner seeks bail in a case initially registered under Sections 307, 376, 511//34 of the Indian Penal Code and 27 of the Arms Act.
Allegedly, while the informant went to cut grass in the field, the accused persons caught hold of and attempted to commit rape with her and in consequence thereof, the informant was shot fire which hit on the left elbow of the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 12-10-2018. Charge sheet has already been submitted. The petitioner has been falsely
Patna High Court CR. MISC. No.13831 of 2019(4) dt.19-07-2019 2/2 implicated in the present case. The injury, caused by the petitioner is on non-vital part of the body. Hence the petitioner had no intention to commit murder of the injured. The petitioner has been made accused in this case due to previous enmity. On behalf of the State and O.P. No. 2 , it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakia) P.S. Case No. 326 of 2017.
