The petitioner is accused in connection with Sonbarsa Raj P.S. Case No. 160 of 2016, registered under Section 25(1-B)a, 26 and 35 of the Arms Act.

The accusation is that in course of patrolling duty, petitioner and one Pundeo Yadav were apprehended by the Police. On search, six live cartridges were recovered from the possession of the petitioner and one loaded country made pistol was recovered from Pundeo Yadav.

Learned counsel for the petitioner submits that petitioner has been made accused in 20 other cases, out of which he has been acquitted in 13 cases and in remaining cases, he is on bail and due to that reason, the petitioner has falsely been

Patna High Court Cr.Misc. No.7016 of 2017 (2) dt.08-03-2017 2/2 implicated in this case showing recovery of six live cartridges from his possession. Further submission is that petitioner is in custody since 20.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj P.S. Case No. 160 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
