JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2019 This application, for grant of anticipatory bail, arises out of Piro P.S. Case No. 416 of 2018, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 30 litres of mahua liquor from his house.

Submission of learned counsel for the petitioner is that in fact nothing has been recovered in this case and he has no criminal antecedent and has falsely been made accused and the house from which, the alleged recovery was made is a joint house.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances and also the fact that petitioner has no criminal antecedent, let the petitioner, above named, in the event of his

No.11050 of 2019(3) dt.26-04-2019 2/2 arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special Judge, Excise Act, Bhojpur at Ara in connection with Piro P.S. Case No. 416 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is made clear that if the petitioner again found involved in any such type of case in future, prosecution shall move for cancellation of his bail bonds.

Let a copy of this order be communicated to the Superintendent of Police, Bhojpur, Ara.
