The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 447, 504 and 506/34 of the Indian Penal Code. The prosecution case is that the petitioner was dismantling the ridge of the land of the informant. On protest being made the petitioner assaulted with spade to the husband of the informant.

It is submitted by learned counsel for the petitioner that the injury report is not available on the record. Though, counsel for the informant submits that the injury has been found grievous.

Patna High Court Cr.Misc. No.4148 of 2016 (2) dt.29-01-2016 2/2 Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dagarua P.S. Case No. 223 of 2015 pending in the court of learned Chief Judicial Magistrate, Purnea.
