Petitioner seeks bail in a case registered for the offences punishable under Sections 447, 307 and 387/34 of the Indian Penal Code.
The petitioner and others fired at the informant for non-fulfillment of their demand of ransom. However, no injury was caused to anyone.
Submission of the petitioner is that the FIR itself would reveal that the occurrence, allegedly, took place in retaliation to the referred criminal case and allegation is general and omnibus.
Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.9832 of 2017 (3) dt.11-04-2017 2/2 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Rosera, Samastipur/successor Court in connection with Sessions Trial No. 608 of 2016 arising out of Singhiya Police Station Case No. 134 of 2014, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
