The petitioner seeks bail in Sadar P.S. case No. 403/ 2019 registered under Section 414, 120B of the Indian Penal Code and u/s 25 (1-b)a, 26(ii) & 35 of the Arms Act. The police on secret information raided the house of Rajeev Kumar @ Ravi Master. Seven persons including the petitioner were found. One loaded country made pistol with two live cartridges were recovered from the possession of the petitioner.

The learned counsel for the petitioner submits that for recovery of one loaded country made pistol and two live cartridges the petitioner is in custody since 13.06.2019. The petitioner has already remained in jail for more than eight

Patna High Court CR. MISC. No.10661 of 2020(2) dt.28-02-2020 2/2 months. Of course the petitioner has got criminal antecedent but similarly situated accused Satyam Kumar has already been granted bail.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that for recovery of one loaded country made pistol with two live cartridges the petitioner has alredy remained in jail for more than eight months, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. case No. 403 of 2019 subject to the condition that one of the bailors shall be father or mother of the petitioner.
