The petitioner apprehends his arrest in Barauni (FCI) P.S.Case No. 360/2014 for the offence under Sections 399/402 of the Indian penal Code and Sections 25(1-B)a, 26 and 35 of Arms Act.

The informant- police officer, alleges that on secret information he intercepted Bolero vehicle bearing registration no.BR-09H-9472 and on search two persons were apprehended, who disclosed their names as Rajesh Kumar @ Bhullu and Dhananjay Kumar and from the possession of Rajesh Kumar, a country made pistol and other articles were recovered. Rajesh Kumar is said to have disclosed the name of the petitioner and the persons who had accompanied him.

Patna High Court Cr.Misc. No.4384 of 2015 (2) dt.02-02-2015 2/2 Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot. Nothing has been recovered from the possession of the petitioner. The petitioner has got no criminal antecedent and his name is figured in the confessional Staement of Rajesh Kumar and Dhananjay Kumar, driver of the vehicle.

Having considered the fact that the name of the petitioner figured in the confessional statements of Rajesh Kumar and Dhananjay Kumar and the petitioner has no criminal antecedent, let the above named petitioner, in the event of his arrest/ surrender before the court below within four weeks from today in connection with Barauni (FCI) P.S.Case No. 360/2014,be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, subject to the conditions as laid down u/s 438(2) Cr.P.C.
