2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Lalganj P.S. Case No. 247 of 2024 registered for the offences punishable under Sections 319(2), 318(4), 323 of BNS and 15(2) of Indian Medical Council Act, 30 of Bihar Clinical Establishments (Registration and Exchange) Rule.
3. The allegation against petitioner is to involve in running of unregistered nursing home along with other co-accused persons.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner not appears to
Patna High Court CR. MISC. No.18368 of 2025(2) dt.16-04-2025 2/3 be connected in any manner with aforesaid hospital in administrative capacity rather he was employed there as nursing assistant. It is pointed out that even before sealing the nursing home i.e., New Adarsh Hospital, police/raiding team could not ascertain the name of the owner of the hospital. It is pointed out that merely as petitioner was found involved in three more criminal case where he is on bail on the basis of suspicion he was implicated with present case also.
5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as petitioner prima-facie not appears handling the controlling affairs of the hospital rather he claimed to be an employee as nursing assistant, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to
Patna High Court CR. MISC. No.18368 of 2025(2) dt.16-04-2025 3/3 the satisfaction of the learned CJM, Vaishali at Hajipur /concerned Court, where the case is pending in connection with Lalganj P.S. Case No. 247 of 2024, subject to the conditions as laid down under Section 482(2) of BNSS. Subject to condition:- (i) That petitioner shall not involve/ indulge in the similar nature of offence till the conclusion of trial, failing which the State shall be at liberty to move before the Trial Court itself for the cancellation of bail bond of the petitioner.
