The petitioner is accused in connection with Udawant Nagar (Gajarajganj O.P.) P.S. Case No. 390 of 2019 corresponding to NDPS Case No. 15 of 2019, registered under Sections 8/20(b)(ii)(c) of the NDPS Act, 1985, pending in the court of learned Sessions Judge, Bhojpur at Ara. The accusation is of recovery of 31 KG Ganja from the house of petitioner and his son, Bablu Singh. Learned counsel for the petitioner submits that it would appear from the search-cum-seizure list that while the seizure was made on 03.10.2019 at about 6.10 P.M. but in column no. 1 of the FIR, it appears that the case has been lodged

Patna High Court CR. MISC. No.10013 of 2020(2) dt.29-02-2020 2/2 on 04.10.2019, which creates doubt about the recovery of alleged Ganja.

Having considered the facts and circumstances of the case and the recovery of huge quantity of Ganja from the house of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
