JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,379 and 504/34 of the Indian Penal Code and sections 3(1)(iv)(x) and (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that when measurement of the land of the informant was going on, the accused persons came, pelted stones and on protest by the informant, Sudama Thakur pelted brick and caused injury on the head of the informant whereas other accused persons took away gold chain and mobile of the informant.
Patna High Court Cr.Misc. No.4785 of 2015 (2) dt.03-03-2015 2/2 It is submitted by the learned counsel for the petitioners that the accusation has been levelled in the background of land dispute. The specific accusation of causing injury is against Sudama Thakur (non petitioner) though a supplementary affidavit has been filed stating that no injury was caused to the informant. Considering the accusation levelled in the background of land dispute, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, Patna in connection with Shahpur P.S. Case No. 27 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
