JUSTICE SANJAY PRIYA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khusrupur P.S. Case No. 211 of 2016 instituted for the offence under Section 379, 279, 304(A) & 409 of the Indian Penal Code and Section 47a & 50 of the Bihar Excise Amendment Act.

It is alleged in the written report that accident took place by a car in which this petitioner was also found sitting and foreign liquor has also been recovered from his possession. It is submitted that seizure list was prepared on the spot from which identity card of this petitioner was recovered and it appears that he belongs to Bihar Police.

It is submitted that petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar Rai, Judicial Magistrate 1st Class, Patna City, in connection with Khusrupur P.S. Case No. 211 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
