JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 411, 489(B), 489(C) and 120(B) of the Indian Penal Code.

From possession of the petitioner seven thousand of fake currency was recovered. The petitioner confessed before the police that the money was provided by co-accused Fagu Sao. Fagu Sao has also admitted that he had given the money. Fagu Sao has already been allowed bail by a coordinate Bench of this Court vide order dated 08.11.2016 passed in Cr. Misc. No. 37582 of 2016. The petitioner is in custody since 23.07.2016 and has got no criminal antecedent. Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.10309 of 2017 (3) dt.11-04-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Masaurhi, Patna/successor Court in connection with Bhagwanganj Police Station Case No. 53 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
