Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act The FIR of the occurrence of murder is against unknown. Co-accused-Abhishek Kumar @ Sumanta confessed before the police that he had committed the murder and the petitioner was also alongwith him. Though the petitioner has got criminal antecedent, there is no substantial material against the petitioner in this case. He is in custody since 05.10.2018. Investigation of the case is already complete against the petitioner.
Hence, let the petitioner, above named, be
Patna High Court CR. MISC. No.10207 of 2019(7) dt.19-06-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Town Police Station Case No.112 of 2015, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
