JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414/34 of the Indian Penal Code and Section 7 of the Essential Commodities Act. It is alleged that 53 bags of rice each containing 50 Kgs. were seized from a pickup van when the driver-cum-owner of the alleged vehicle confessed that the rice is being carried from the PDS shop of this petitioner.

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled when no verification of the PDS shop of the petitioner has been made and other co-accused Chanchal Singh has been granted anticipatory bail by this Court vide Cr. Misc. No. 1792 of 2015. Considering the aforesaid facts, let the above named
