Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State through video conferencing.

The petitioners apprehend their arrest in connection with Lakhnaur P.S. Case No. 300 of 2020 registered for offence punishable under sections 341, 323, 354, 307, 379 and 504/34 of the Indian Penal Code.

No.11612 of 2022(2) dt.16-09-2022 2/3 As per allegation, petitioner no. 1 was digging soil near the house of the informant and on protest, the accused persons, including the petitioners assaulted him with iron rod, lathi, etc. The specific allegation against petitioner no. 1 is that he ordered to kill the informant whereupon petitioner no. 2 inflicted iron rod blows on his head.

The learned counsel for the petitioners has submitted that the petitioners are the persons of clean antecedents. The informant and petitioner no. 1 are full brothers. There is case and counter case and the members of defense side have also sustained injuries. He has submitted further that though the injury on knee of the informant was found to be grievous, but that has not specifically been attributed to any of the petitioners. Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jhanjharpur in connection with Lakhnaur P.S. Case No. 300 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the
