2. The petitioner apprehends her arrest in a case registered for the offence under Sections 406, 420, 34 of the Indian Penal Code.

3. In this case, a supplementary affidavit has been filed on behalf of petitioner and in paragraph - 2 of the same, it is stated that after deduction of 20% of the admitted amount of Rs. 29,60,000/-, which comes to Rs. 23,68,000/- will be returned by the petitioner to the informant and out of which, Rs. 3,60,000/- has already been returned to informant. Therefore, the remaining amount comes to Rs. 20,08,000/-, which the petitioner is ready to pay in installments to the informant.

4. However, learned counsel for informant disputes the admitted amount.

5. Considering the aforesaid facts and circumstances,

Patna High Court CR. MISC. No.11527 of 2023(6) dt.01-08-2023 2/2 in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Danapur (Patna) in connection with Danapur P.S. Case No. 26 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, in the light of following terms and conditions:

A. At the time of furnishing bail-bond Rs.

2,50,000/- (Rupees two lacs fifty thousand) shall be deposited through Bank Draft.

B. Rest amount i.e. Rs. 17,58,000/- (Rupees seventeen lacs fifty eight thousand) in 20 (twenty) equal monthly installment at the rate of Rs. 87,900/- per installment within a period of two years from the date of furnishing bail-bond.

C. If petitioner fails to comply with the aforesaid direction of this Court, the Court below is free to cancel the bail-bond of the petitioner.

6. It is made clear that without going into the merit of the case, the aforesaid order has been passed only for the purpose of grant of bail.
