2. The order was dictated in Court in which conduct of learned counsel for the opposite party no. 2 was taken note of. However, at the time of signing of the order, the Court, in the overall interest of the Institution, deemed it appropriate to recall such order, without changing the end result, and restrict it only to observing that the Bar and the Bench being two sides of the same coin, such uncalled-for conduct of learned counsel is highly unfortunate and needs deep introspection.

3. Learned counsel for the petitioner informed the Court that the petitioner died on 19.04.2019 and the criminal case against him having abated, the issue, for all practical purposes has become infructuous and that he shall not press the application on merits.
