The petitioner seeks bail in connection with S.T. No. 76 of 2019, arising out of Rajapakar P.S. Case No. 152 of 2014, registered under Section 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that, earlier, the bail prayer of the petitioner was refused by this Court on 20.02.2019 passed in Criminal Miscellaneous No. 80814 of 2018 with direction to the trial Court to conclude the trial of the petitioner within nine months from the date of commitment of the case. Further submission is that case of the petitioner committed to the Court of Session on 12.02.2018 and out of seven Chargesheet witnesses, only two witnesses

Patna High Court CR. MISC. No.9875 of 2020(2) dt.28-02-2020 2/2 have been examined up till now. There is no chance of conclusion of trial in near future. The petitioner is in custody since 23.07.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-I, Vaishali at Hajipur in connection with S.T. No. 76 of 2019, arising out of Rajapakar P.S. Case No. 152 of 2014.
