The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

The prosecution case is that the miscreants snatched driving licence, registration document of the motorcycle and rupees one hundred fifty from the informant leading to the registration of the case against unknown. The petitioner is not named in the FIR. His name sprang up on confession of co-accused during investigation. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner. The

Patna High Court Cr.Misc. No.6502 of 2016 (2) dt.11-02-2016 2/2 impugned order suggests that the name of the petitioner sprang up on the confession of co-accused Vikky Yadav and chargesheet has been submitted under Section 392 of the IPC. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Chewara P.S. Case No. 36 of 2015 pending in the court of learned Sub-divisional Judicial Magistrate, Sheikhpura.

With the aforesaid observation, this application is disposed of.
