JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Maner P.S. Case No. 508 of 2015, registered under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that 28 persons named in the F.I.R. including the petitioner variously armed with weapons restrained the informant and others. On protest, on the order of Ajay Kumar @ Ajay Kumar Singh, Raju Kumar @ Rajiv and Bablu Kumar and Ajay Kumar caused firearm injury to Manager Rai. In that course, 17 persons including the informant also sustained injury. Learned counsel for the petitioner submits that while

Patna High Court Cr.Misc. No.6205 of 2017 (3) dt.22-03-2017 petitioner is named in the F.I.R. but no specific overt act has been attributed against him. It is further submitted that petitioner has no criminal antecedent and is in custody since 15.06.2016 and similarly situated co-accused, Ajay Kumar @ Ajay Kumar Singh, has already been granted privilege of bail by this Court vide order dated 06.03.2017 passed in Criminal Misc. No. 2691 of 2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Danapur, Patna, in connection with Maner P.S.
