2. The petitioners seek bail in connection with Jurawanpur P.S. case No. 151 of 2023 instituted for the offences under Sections 302/34 of the Indian Penal Code.

3. Prosecution case, in short, is that all the accused persons including the petitioners assaulted the informant, her son, her husband and her mother-in-law. It is further alleged that co-accused Vishwanath Ram assaulted on the head of the

Patna High Court CR. MISC. No.10517 of 2025(2) dt.14-02-2025 2/3 informant by iron rod and he fell on the ground, thereafter, all the accused persons fled away.

4. Learned counsel for the petitioners submitted that the petitioners have falsely been implicated in the present case. Learned counsel for the petitioners submitted that general and omnibus allegation has been made against the petitioners. No specific overt act is alleged against the petitioners rather the specific allegation of assaulting on the head of the informant is against co-accused Vishwanath Ram. It has been submitted on behalf of the petitioners that the petitioners are in custody since 17.12.2024 and have no criminal antecedent. The co-accused person has already been granted bail by this Court vide order dated 13.03.2024 passed in Cr. Misc. No. 16288 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case, claim based on parity, as also the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Court
