JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149 /302 /307/ 337/ 338/427/342 of the Indian Penal Code.

Co-accused Santu Paswan and Kailash Paswan have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.36011 of 2016 considering the submission of charge sheet as well as the fact that there is no need of further detention of the petitioners in this case. Though charge sheet has not been submitted against the petitioner as yet, however, the allegation is similar to that of co-accused Santu Paswan and Kailash Paswan.

No.16297 of 2017 (2) dt.04-04-2017 2/2 Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court, in connection with Mahua P.S. Case No.220 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
