The petitioner seeks regular bail in connection with Sikarhatta P.S. Case No. 79 of 2018 for the offences punishable under Sections 414 of the Indian Penal Code and Sections 25(1b)a, 26, 35 of the Arms Act. The allegation is regarding the police having apprehended the petitioner and one other accused person, while they were traveling on motorcycle and as far as the petitioner is concerned, no recovery was made, however, as far as coaccused person is concerned, i.e. the person sitting at the back of the motorcycle, which was being driven by the petitioner, one country made pistol and one cartridge were recovered. The learned counsel for the petitioner submits that the

It is further submitted that through the petitioner is accused in one other case, but he is on bail in the said case. The petitioner is languishing in custody since 18.10.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Piro, Bhojpur in connection with Sikarhatta P.S. Case No. 79 of 2018.
