JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-09-2022 Heard learned counsel for the petitioner and learned APP for the State and also perused the supplementary affidavit which is filed today in the Court itself.

The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. As per FIR, the allegation against the petitioner is that she obtained appointment as Panchayat Teacher on the basis of fake certificates.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has already submitted her resignation on 05.09.2022 sent through registered post dated

Patna High Court CR. MISC. No.10936 of 2022(4) dt.13-09-2022 2/2 08.09.2022 to the Block Education Officer, Biraul, DistrictDarbhanga with a copy to Headmaster of Primary School, Rajwa as well as to the Headmaster, Primary School (Indira Awas), Fakirana. The petitioner has been suffering from illness since long which would be evident from the Medical Prescriptions and reports.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Biraul, District- Darbhanga in connection with Biraul P.S. Case No. 288 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
