JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 406, 420 and 504/34 of the Indian Penal Code. It is alleged that Ram Sharan Paswan being husband of Ward Member took `25,000/- from the informant for releasing second installment of the money under Indira Awas Scheme, subsequently, the informant demanded her passbook from Ram Sharan Paswan, then these petitioners caught hold the informant when Ram Sharan Paswan assaulted him.
It is submitted by learned counsel for the petitioners that there is no injury to the informant and Ram Sharan Paswan has been granted anticipatory bail by this Court vide Cr. Misc. No. 38506 of 2013. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.4584 of 2015 (2) dt.04-02-2015 2/2 petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani in connection with Laukaha P.S. Case No. 28 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
