The petitioner seeks bail in connection with Sultanganj P.S. Case No.261 of 2019 [G.R. No.4782 of 2019] registered under Sections 341, 323, 406, 420 and 379 of the Indian Penal Code. The accusation is that the petitioner being the staff of Shashi Kumar Tanti took cash Rs.54400/- from Shivam Kumar, the brick kiln owner, for the insurance of three motorcycles, one car and five tractors from the Reliance Insurance Company and the receipt was also issued by him in this regard but the money was not deposited in the Reliance Insurance Company, due to that reason the insurance policy of the vehicles was cancelled. Thereafter, the money was demanded from Shashi Kumar Tanti before whom the petitioner admitted about receiving of the aforesaid money and

Thereafter, Shashi Kumar Tanti called the informant Umesh Kumar, the employee of the brick kiln in the flat of the apartment, situated at Khanjarpur. When the informant made demand of money from the petitioner, the petitioner, Shashi Kumar Tanti and others assaulted the informant, and snatched his gold chain and cash Rs.8000/-.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and has falsely been implicated in this case being the staff of Shashi Kumar Tanti. The petitioner is in custody since 17.10.2019 and, on investigation, the police has already submitted the charge-sheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Sultanganj P.S. Case No.261 of 2019 [G.R. No.4782 of 2019].
