The petitioner seeks bail in a case registered under Sections 376/511 of the Indian Penal Code and Section 8 of POCSO Act.
Allegation is that the petitioner within intention of rape upon the victim threw her on the ground and untied her garment.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.01.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. There is title suit pending between the parties. Due to said reason, the present case has
Patna High Court CR. MISC. No.13998 of 2019(3) dt.18-04-2019 2/2 been instituted. There is no allegation of commission of rape. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1, Sheikhpura in connection with Ariyari Kassar P.S. case No.62 of 2018, POCSO case No.16 of 2018.
